A budget strong increase in the simplifications in the jungle of texts and procedures, and the announcement of new structures in the region of Occitania : the keeper of the Seals gives details of its measures for an institution that is under tension.
For the French justice is slow, complicated, difficult to access. What your law does it improve the situation ?
The act that I wear is an act of reform, but also a act of ways. The programming budget will, in five years, lead to an increase of 24 % of the budget to reach eur 9 billion, and the creation of 6,500 jobs, to be divided between the courts, the prison and the judicial protection of youth : it is an important effort in the context of a government budget constrained.
Justice is too slow ? It can be in some cases. The act provides numerous measures. I will mention the issue of divorce, which affects the daily life of the people, because it is often the first contact with the justice system, although, fortunately, all the world cannot divorce. Divorces that are not by mutual consent, but who go before the judge, on average, it takes two years. We propose, by removing unnecessary administrative burdens, moving on to a year to have a decision stabilized. And we do this by maintaining the ability to have very early provisional measures to protect the children.
And to simplify access to the justice ?
When you go before a judge, you do not know which court to go to. Court of first instance, large instance : we propose to simplify all this by saying that from now on, there will be only one court. It will not be necessary to return the folders back if it is not in the right place. Today, there must first be a judgment that says : ah ben non, it is not in me, it is the neighbor, which is a waste of time.
This court will be implemented in all places that exist today of the courts. And for the civil, we shall enter by a single referral procedure, where today there are five.
The simple access to justice will also result in the closeness that I maintain. All the courts remain in place, and in the courts of proximity, we are going to maintain all of the disputes of daily life : over-indebtedness, leases, guardianship, everything that makes up the daily life of the people.
One accuses the justice to be sometimes unable to enforce the decisions that it takes. What to do ?
It is important to ensure that the French believe in their justice. Today, it often happens that sentences are never enforced. We wish to put an end to this. The judges will deliver a sentence other than imprisonment, or if it is a prison sentence of at least one year, it will be executed. There will be no development possible in the beginning of the sentence.
This doesn’t it lead to explosion of the penal population ?
No, because we take other measures that aim to reduce short prison sentences. First, we prohibit prison sentences of one month, that do not serve absolutely nothing, and between one and six months, we say to the magistrates that in principle, there are other penalties that should be preferred to imprisonment.
The magistrate will be able to directly say : I you place for four months under electronic bracelet, with a judicial review. The idea is to reduce the short sentences : it has 90 000 sentences of less than six months !
Prisons in Occitania are among the most crowded of France. What are your solutions ?
The philosophy of this law, it is 15 000 places in prison in 2022, compared to what we found when we arrived. We are going to spend in France from 60 000 to 75 000 places in prison. 7 000 seats will be delivered in 2022 and 8 000 launched before 2022.
Increase the budget, simplify, accelerate, and enhance the efficiency : this is what will change in our justice
These institutions will be diversified : all prisoners do not require very high levels of security. We have held in the classical scheme, with closed cells, and held in the plan trust, with open cell and mandatory activities in the day. We will also build support Structures to the output of SAS, designed to take care of for a year or short sentences, for sentence in preparation for release.
In Occitania, there will be a SAS a 150-seater in Montpellier, before 2022, an extension of 150 seats in the house of judgment of Nîmes, also before 2022. We create two prisons in France and in Perpignan, which will be delivered after 2022, and another in Muret, near Toulouse.
And the closed educational centres for minors ?
We create twenty new France, including eight in Occitania, before 2022 : Montpellier, Nimes, Narbonne, in the Aveyron, the Tarn, the Gers, the Tarn-et-Garonne and Haute-Garonne.
Where is the idea of a new administrative court of appeal ?
The decision is made, there will be a ninth court, and it will be in Occitania. We refine the study to see if this will be in Toulouse or Montpellier. The decision will probably be taken quickly enough. In Toulouse, there is a pooling with the reconstruction of the administrative court, which could be considered.
Beyond these changes in structures, how to make, that the French have trust in the justice ?
It is important to ensure that the French believe in their justice. You can see this clearly with the rise of fears relating to the abuse of young people. But there is in this text a series of measures to give more confidence, facilitating the removal of offenders from neighborhoods or by developing a strong response and quick to the use of narcotics.
We never listen too, but to govern is to decide, is to decide, is to choose.
This act also simplifies the criminal procedure to accompany the deployment of the security police of the everyday and the determined action of the security forces in the neighbourhoods of reclaiming a republican-led Christophe Castaner and Laurent Nuñez. I will accompany this policy with magistrates to really have a penal policy adapted to the particular situation of these districts. This is very important, this responsiveness. This is what will allow us to fight against the networks and the traffics.
But in these districts also criticized President Macron and to the ministers not to listen to the French ?
It has catalogued the government in this type of attitude and I think that is basically incorrect. My colleagues and myself, we are very often on the ground, and we listen. We never listen too. But when one is a politician, it is necessary to make choices, and by definition, these choices may not suit everyone. Then, of course, when one goes to the pump, the price of diesel has increased. But if you exceed the individual situation, one realizes that in a general interest objective, it is necessary to move towards low-carbon energy. There are compensatory measures that can be taken. As has been said by the president of the Republic, it is necessary to help those who must take their vehicle to go to work. The Prime minister and the government are mobilized to find those solutions. We never listen too, but to govern is to decide, is to decide, it is to make choices, and it is to accompany.

“It is a happiness, because with the people with whom I work, in my office, with directors of central administrations, and with many of my fellow ministers, we feel a strong sense of cohesion. It is also a challenge, because I am someone who doubts, I drive my action with a lot of determination, but also, always, questions. I think that it is healthy and important : to know if what we do is useful and fair. And yes, of course, it’s a test. The test, it is physical. There are a lot of ministers who are less than 40 years old, so it may be that for them, it is less physical, but for me… (laughter). The test, it is also emotional. I’m away from my family, I see little, and when I see it, there are always things on the agenda.
It does not accept
Poverty. People who are not able to get out of it. A family who lives with 800 € per month, or sleeping in the street, and it made me unworthy, because we are a rich society. And this is the meaning of the policies we pursue today : whether to bring back the people who are remote to the job or, for example, the plan of the fight against poverty, implemented by Agnès Buzyn.
His own future
The public life, it has always been my passion. To be a minister, is to perform a function full-time : during the time when I do it, there is only that which interests me. I am unable to tell you what I will do in three, five, ten years. I have absolutely no career plan. This is a weakness, indeed, but I have always worked like that. And then, I’ll tell you, doing nothing, it is extraordinary !
